Allison Transmission Privacy Policy

This Allison Transmission, Inc. (“Allison,” “we,” “us,” and “our”) Privacy Policy describes (i) the types of information we gather about users (“Users,” “you,” and “your”) of (a) websites and service when you access or use our digital properties, available at http://allisontransmission.com, http://allisontransmissionpublications.com, https://allison.corpmerchandise.us, https://www.allisonelearn.com, www.vantage-power.com, walkerdiecasting.com, all related sites and mobile applications we may provide, and via other online submissions by you to Allison (together, the “Site”), and (b) products (“Products”) that collect, store, and share Products Telematics Data and Fleet Vehicle Data (defined below); (ii) how we may use that information; and (iii) the choices you have regarding our use of that information.

 

This Privacy Policy supplements and is incorporated as a part of Allison’s Terms of Use available at the Site and Allison’s Product-specific data sharing agreements. Allison will act as the controller of all personal data that we collect about you through your use of the Site and Products.

 

Under the headings below, we have set out information regarding how Allison collects, uses, and transfers personal data through the Site and Products.

Right To Modify Privacy Policy

Allison may alter this Privacy Policy at any time, including to comply with privacy laws, regulations, and/or our own or industry standards, business practices, or otherwise.

If we make material changes to this this Privacy Policy regarding the ways in which we use or disclose data that we collect, we will use reasonable efforts to notify you (such as by posting notice of such changes on the Site, or by other means consistent with applicable law). We encourage you to review this Privacy Policy each time you access or use the Site or Products. Changes to the Privacy Policy will become effective and will apply to personal data processed and information collected starting on the date we post the revised Privacy Policy to the Site.

In jurisdictions where consent to this Policy may be required, your use of the Site or Products indicates your acceptance of this Privacy Policy and the Terms of Use, including any changes made to this Privacy Policy or the Terms of Use.

Our Use of Your Personal Data

Allison may collect personal data from you, which will be processed for the specific purpose given at the time of collection, or for a purpose stated in this Privacy Policy. Personal data is information that either identifies you or makes you identifiable (either alone or with other information we hold about you). 

We will only process your personal data where we have a valid legal basis for doing so under applicable data protection laws. In each case, our legal basis for processing is set out below.

You generally do not need to provide us with personal data to use the Site to obtain information from most of the features on the Site.

Finally, we may deidentify your data such that it cannot reasonably be used to infer information about you or otherwise be linked to you (or we may collect data that has already been deidentified), and we may use such deidentified data for any purpose. For example, we also collect the following categories of data, although these do not contain personal data:

  • Site Aggregate Information, meaning general, non-personal, statistical information about the use of the Site, such as how many visitors visit a specific page on the Site, how long they stay on that page, and which hyperlinks, if any, they click on;
  • Product Telematics Data, meaning parameters relating to the operation of Allison Products such as: telemetry regarding performance; logging report; usage; operation; Product year, make, model, health and identification number; configuration; service or repair status; safety event information; and location; and
  • Fleet Vehicle Data, meaning data from our partners who operate fleets of vehicles and telematics solutions providers who capture and report on data associated with fleet vehicles, which helps us identify and resolve issues associated with the operation and performance of Allison transmissions and/or other powertrain components and assemblies, provide fleet vehicle insights, and research and develop activities associated with our products and service. End users will enter a separate data sharing agreement that will govern the sharing and use of fleet vehicle data.

To the extent we possess or process any deidentified data, we will maintain and use such data in deidentified form and not attempt to re-identify the data, except solely for the purpose of determining whether our deidentification process satisfies legal requirements.

In some cases, you may be asked to provide personal data to access or use certain pages and services of the Site, or to allow us to provide you with certain personalized or enhanced services that you have requested. How we collect and store information depends on the page you are visiting, the activities in which you elect to participate, and the services provided. As noted, you can access or use many pages and services on the Site without providing any personal data. Still, other pages and services may prompt you to provide personal data.

Cookies and Other Tracking Technologies
The Site also may collect information automatically and using electronic tools. For example, we may automatically collect personal data using “cookies.” Cookies are small text files a website uses to recognize repeat Users, facilitate the User’s ongoing access to the website, and facilitate the use of the website. Disclosures and Transfers of Information

We do not disclose your personal data, except where the disclosure falls into one or more of the following categories: 

  1. The disclosure is to outside businesses to perform certain services for us, such as maintaining the Site, mailing lists, processing orders and delivering products and services, sending postal mail, processing, providing marketing assistance, data analysis, etc.;
  2. The disclosure is to persons or entities for whom we are providing services, provided the disclosure is consistent with the purpose for which the personal data was obtained;
  3. The disclosure is pursuant to our data sharing agreement with fleet vehicle partners and telematics solutions providers;
  4. The disclosure is part of a business transaction, in which Allison undergoes a process such as a merger, acquisition by another company, or sale of all or a portion of our assets;
  5. The disclosure is to permit other businesses to perform certain services for us, such as hosting or maintaining the Site, storing your information, processing orders or subscriptions, or providing marketing assistance and data analysis.
  6. The disclosure is to financial service providers or other similar service providers to fulfill and carry out the purchase and provision of goods and services requested by you; or
  7. The party to whom the disclosure is made controls, is controlled by, or is under common control with Allison.

Please note that some Allison group companies are (and some of our service providers may be) based outside the European Economic Area (“EEA”) and the UK, and your personal information may be transferred to locations which do not have the same standards of data protection law as within the EEA and the UK. Where we do so, we ensure that your personal data is subject to safeguards in accordance with applicable data protection laws. As a Service to Others

We may provide your personal data to third parties for their marketing and/or advertising purposes, but only if we are permitted to do so under applicable laws relating to direct marketing in your jurisdiction. Users of the Site are given the opportunity to consent to the disclosure of their personal data to a third party or to the use of such information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the User. We do this to ensure that our Users can make an informed choice as to whether they want to share their information with such outside parties. We will provide individuals with a compliant mechanism to exercise their choices.

If you have authorized us to share such information about you with others and later notify us that you no longer want us to share your information, we will cease sharing your personal data for this purpose. However, except as otherwise stated in this Privacy Policy, we do not control the third parties with whom we share such information, and you will need to further notify such this parties if you would like them to cease use of your information.

Data Security and Integrity

We take reasonable precautions designed to protect the privacy, accuracy, and reliability of any information you provide and that we collect and to protect such information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. The personal data you provide and we collect is stored within databases that are controlled by us or by our service providers. Since no security system is impenetrable, we cannot guarantee the security of our databases, nor can we guarantee that information you supply, and we collect will not be intercepted while being transmitted to us over the Internet. 

If you create an account on the Site, you may be asked to choose a password for your account, in which case your online account information shall be protected by your password. You may not disclose your password to any other person. You are responsible for maintaining the confidentiality of your password and Site account and are fully responsible for all activities that occur under your password or Site account. You can access and update information in your account profile at any time by logging in to the website with your login name and password. Once you have logged in, you can update certain information such as your name, email, and password.

Accessing and Deleting Personal Data; Opt-Out

If you have submitted personal data through the Site, you may be able to review, edit, and control how we use much of this information, by visiting the “My Accounts” webpage. Otherwise, you may be able to access or edit such information by contacting us at webmaster@allisontransmission.com. We may require proof of your identity before we edit or provide you with the requested information. We will use reasonable efforts to supply you with this information and to correct any factual inaccuracies that you identify.

Please also contact us at webmaster@allisontransmission.com if you want us to delete your personal data from our databases.

Additionally, depending on your location, you may have the right to do the following where we process your personal data:

  • Request an explanation of our processing of that data and access to a copy of the personal data that we process;
  • Receive any of your personal data which you have provided to us, in a structured, commonly used and machine-readable format and to transmit those data to a third party, in certain situations;
  • Object at any time to processing of personal data concerning you for direct marketing;
  • Object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you;
  • Object in certain other situations to our continued processing of your personal data; and
  • Otherwise restrict our processing of your personal data in certain circumstances.

Depending upon your location, you may also have the right to complain to your national data protection authority if you are unhappy with how we have used your personal data. This includes the Information Commissioner’s Office in the UK and national data protection authorities in the European Union (as set out here).

Other Sites, Links, and Advertisements

Allison expects partners, advertisers, and third-party affiliates to respect the privacy of our Users. However, third parties, including our partners, advertisers, affiliates, and other content providers accessible through the Site, may have their own privacy and data collection policies and practices. For example, during your visit to the Site you may link to, or view as part of an Allison Site page, certain content that is actually created or hosted by a third party. Also, you may be introduced to, or be able to access, information, websites or advertisement features offered by other parties through the Site.

In addition, certain features of the Services may allow you to initiate interactions between the Services and third-party services of platforms, such as social networks (“Social Features”). Social Features include features that allow you to access our pages on third-party platforms, and from there “like” or “share” our content. Use of Social Features may allow a third party to collect and/or use your information. If you use Social Features, information you post or make accessible may be publicly displayed by the third-party service. Both we and the third party may have access to information about you and your use of both the Site and the third-party service.

Allison is not responsible for the actions or policies of such third parties. You should check the applicable privacy policies of those third parties when providing information on a feature or page operated by a third party.

Do Not Track Signals
Certain web browsers and other devices you may use to access the Site may permit you to indicate your preference that you do not wish to be “tracked” online. At this time, the Site does not respond to “Do Not Track” signals and we do not use or disclose your data in any way that would legally require us to recognize opt-out preference signals. California Residents

This section applies to you if you are a California resident (“resident” or “residents”). For purposes of this section, references to “personal information” shall include “sensitive personal information,” as these terms are defined under the California Consumer Privacy Act (“CCPA”).

The specific business or commercial purposes for which we collect or disclose your personal information and the categories of sources from which we collect your personal information are described in the sections above, Our Use of Your Personal Data and Disclosures and Transfers of Information. We only use and disclose sensitive personal information for the purposes specified in the CCPA. The criteria we use to determine how long to retain your personal information is described in the section below, Retention of Personal Data.

Selling and/or Sharing of Personal Information
We do not “sell” or “share” (as those terms are defined under the CCPA) personal information, nor have we done so in the preceding 12 months. Further, we do not have actual knowledge that we “sell” or “share” personal information of residents under 16 years of age.

Your California Privacy Rights
As a California resident, you may have the rights listed below in relation to personal information that we have collected about you. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

  • Right to Know. You have a right to request the following information about our collection, use and disclosure of your personal information:
    • categories of personal information we have collected or disclosed for a business purpose;
    • categories of sources from which we collected personal information;
    • the business or commercial purposes for collecting personal information
    • categories of third parties to whom the personal information was disclosed for a business purpose; and
    • specific pieces of personal information we have collected.
  • Right to Delete. You have a right to request that we delete personal information we maintain about you.
  • Right to Correct. You have a right to request that we correct personal information we maintain about you.

You may exercise any of these rights by contacting us using the information provided below. We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address, government issued ID or date of birth, before providing a substantive response to the request. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

Other State-specific Privacy Rights
Some other U.S. States also have laws that provides that their residents have a right to request businesses to tell them how their Personal Information has been shared with third parties, if at all, for the third parties’ direct marketing purposes. Children
We understand and share your concerns regarding your children’s access to the Internet and the Internet’s access to your children. Consistent with the Children’s Online Privacy Protection Act of 1988 (“COPPA”), we do not knowingly request or accept Personally Identifiable Information submitted to the Site by any visitor under 13 years of age. If we become aware that an individual under age 13 has provided information to Allison through the Site, we will make commercially reasonable efforts to delete such information from our databases.
Retention of Personal Data
Any personal data that you provide to us will be retained only for the period necessary to carry out the purposes referred to in this Privacy Policy, or as otherwise specified at the time that personal data is collected. When determining the length of time to retain your data, we consider various criteria, including whether we need the data to continue to provide the Site and our Products, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity, or protect ourselves, including our rights, property or products.
